I have a new appreciation for the grocery store. I was somehow struck by the plainness of folks. They wander down the aisles in an unguarded fashion seeking items to satisfy their needs and desires. I guess working in the hospitality industry has jaded the reality of people. Each day I see folks dressed to go “out.” Their makeup and hair is just right. Clothes are neatly pressed. The people communicate in hushed protective tones. I guess when people go to the grocery store they don’t really give a crap. Neither do I.

Here is my response...

Ok, let me ask a few more questions regarding the Constitutionality of an Iraqi war.

If Congress has the power to declare war, where does the Constitution state how such declaration is made? The document doesn’t say Congress can’t abdicate its responsibility. Why can’t Congress transfer to the executive branch a power if only regarding a single matter? I thought Article I section 8 states, “…To make all laws which shall be necessary and proper for carrying into execution the foregoing powers, and all other powers vested by this Constitution in the government of the United States, or in any department or officer thereof.” Isn’t the resolution a law necessary and proper for the carrying into execution of the power to declare war?

A silly example to help others…

Joni has the power “to paint her toenails.” She also has the power “ to determine how such powers be implemented.” So is it “Unconstitutional” if Joni decides to let her husband paint her toenails?

I posted this over at Hooked on Blogging

For weeks now, I keep hearing (reading) JB rant about Constitutional Authority concerning the United States and Iraq. So there was only one thing left to do…that’s right, read the Constitution. I know we have all read it once. I believe the politicos in Washington have bastardized the Constitution too. However, Here is what I found.
First, in article 1 sec. 8. “The Congress shall have the power…To define and punish piracies and felonies committed on the high seas, and offenses against the laws of nations;” I don’t really know what an offense against the laws of nations would be exactly, but I have a feeling Iraq has committed such an offense. After all, haven't they violated the surrender deal from 1991? Wasn’t that in accordance with the United Nations? So wouldn’t that be “laws of nations?” I don’t know…just asking.
We all know “The Congress shall have the power…To declare war, …etc. etc.” (Same article by the way) So does that mean when Congress passes a resolution they should say “declare war?” Just how is the language different? Congress tells the President he can use troops in the resolution. Why isn’t that declaring war?
Now let me jump down to Article VI. It states, “…This Constitution, and the laws of the United States which shall be made in pursuance thereof; and all treaties made, or which shall be made, under the authority of the United States, shall be the supreme law of the land; and the judges in every state shall be bound thereby, anything in the Constitution or laws of any State to the contrary notwithstanding.” Are the treaties made not the supreme law of the land? I don’t even pretend to know what’s in any treaty but I would think we have recourse against Iraq if they violate one.
Now here is some interesting language from Article IV. “Section 4. The United States shall guarantee to every state in this union a republican form of government, and shall protect each of them against invasion; and on application of the legislature, or of the executive (when the legislature cannot be convened) against domestic violence.” I’m not sure but I think the Government has a duty and obligation to protect all the states against a possible invasion. Is it possible or even conceivable that Iraq could invade the US? What exactly does invade mean anyway?
You know it’s funny, I was thinking this whole time that it is Un-Constitutional for the U.S.A. to bomb the crap outta Iraq…But after reading the Constitution, I might have changed my mind.

Ahh!….The cool crisp smell of fall it the North Georgia Area today. The night air smells of pumpkins, chimney smoke, and warm blankets. This is my favorite time of year. It’s deer season too!

Some days are like car crashes while other days drift along on a poetic breeze. Today was perhaps the greatest day in Georgia sports history. The Dogs beat Alabama, the Braves won too. The Yankees were eliminated and the Florida Gators lost too. How perfect is that?
Every other Saturday is an inventory day at work. We managers have to count all food, paper, and liquor. This is not a big deal unless you are scheduled off. Yet that little fact couldn’t bring me down because of the previously mentioned sports wins and losses. I go into a store, late, crank out some inventory, eat a little something, then while leaving, two employees invite me out to another bar for a drink. Cool. I usually don’t go out for drinks for two main reasons. The first reason being my wife and family, the second D.U.I. chances. I would rather drink in the safety of my home. However, I was flattered by the invitation and accepted. The minute I walked in, I saw a customer of ours in the bar. I think my appearance shocked him. See, I never go out with staff after work. Any way, He bought me a beer while the others bought me a couple of shots. I like drinking for free. I guess it feels nice to be accepted as “one of the guys” instead of the boss sometimes. It’s too bad I’ll end up firing them one day….
